Terms and Conditions

1. About these terms

These Terms and Conditions apply to all interior design, cabinet design, fabrication and installation services and products provided by Wayes Design (JY DIRECT TRADING SDN BHD, "we" or "us") to you ("you" or the "Client"). By accepting a quotation, paying a deposit, signing an agreement or using our website, you agree to these terms.

2. Quotations and orders

• A quotation is valid for the period stated on it. Prices may change after that period.
• An order is confirmed only when you accept the quotation in writing and pay the agreed deposit.
• The quotation lists the scope of work. Anything outside it is a variation and is handled under section 5.

3. Design and approvals

• Drawings, 3D renders and samples are for illustration. Actual colours, textures and finishes may differ slightly from screens, prints and samples.
• You must check and approve the final drawings, measurements, materials and finishes in writing before production starts.
• After approval, changes may cost extra and may delay delivery.
• Designs, drawings and renders remain our intellectual property. You may not copy them or give them to others to build without our written consent.

4. Payment

• Payment is made in stages as set out in your quotation or agreement.
• Deposits are non-refundable once materials are ordered or production has started, except where we are unable to deliver.
• Late payments may delay work. We may charge reasonable interest on overdue amounts.
• Goods remain our property until they are paid for in full.

5. Changes and cancellation

• Any change to the scope, size, material or design must be agreed in writing. We will tell you the extra cost and time before proceeding.
• If you cancel, you must pay for work done, materials ordered and any costs we cannot recover. Custom-made items cannot be cancelled once production has started.

6. Delivery, site access and installation

• Timelines are estimates. Delays caused by you, your other contractors, building management, the site, approvals, supply shortages or events beyond our control are not our responsibility.
• You must provide safe, clear and timely access to the site, along with power, water and any permits needed from management.
• Site conditions, such as uneven walls or floors and hidden pipes or wiring, may affect the work. We may need to adjust the design or charge extra, with any variation discussed before proceeding.
• Please inspect the work on completion and tell us in writing of any visible defects or missing items within 7 days.

7. Warranty and care

We will repair defects in workmanship or materials reported within the applicable warranty period. Our current published coverage is a 2-year product warranty and a 1-year installation service guarantee. Aluminium cabinets have a 10-year product warranty against body corrosion defects. The applicable start date and terms are set out in your quotation or agreement and our Warranty Information page.

We provide 1 year of post-installation adjustment support for minor touch-ups, including door alignment, silicone filler and hardware adjustment for additional purchase items.

• Warranty does not cover normal wear and tear, natural variation in wood or stone, or damage from misuse, water, moisture, pests, heat or fire, or repairs and changes by others.
• Please follow our care guidance to keep your cabinets and finishes in good condition.

8. Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of use or loss of profit. Our total liability for any claim is limited to the amount you paid us for the work concerned. Nothing here limits any right you have under Malaysian consumer protection law that cannot be excluded.

9. Photos and portfolio

We may photograph or film completed work and use it in our portfolio, website and marketing. We will not show your name or exact address without your permission. Tell us in writing if you do not want your project featured.

10. Privacy

We handle your personal data as described in our Privacy Notice.

11. General

• These terms and your signed quotation or agreement make up the whole agreement. If they conflict, the signed agreement prevails.
• These terms are governed by the laws of Malaysia. Disputes are first discussed in good faith and, if unresolved, go to the Malaysian courts.
• We may update these terms from time to time. Changes do not affect orders you have already confirmed.
